1.1 MatchTutor ("we", "us", "our") is an online tutoring marketplace ("Platform") operated as a general partnership (ABN 57 896 085 477) in Australia.
1.2 Our Platform connects a person who engages a tutor to provide tutoring services ("Student" or "Parent") with independent tutors ("Tutor").
1.3 By signing up to matchtutor.com.au, you agree to these Terms & Conditions.
2.1 MatchTutor is an online platform that facilitates introductions between Students and Tutors. We are not a tutoring agency, employer, or service provider.
2.2 MatchTutor does not employ Tutors. All Tutors are independent contractors.
2.3 MatchTutor does not guarantee the quality or suitability of any Tutor on the Platform.
2.4 All arrangements including scheduling and payment are made directly between the Student and Tutor. MatchTutor is not a party to that arrangement, and does not process, hold, or facilitate any payments.
3.1 You agree to provide accurate information when creating an account.
3.2 You are responsible for your account credentials.
3.3 You must be 16 or older to create an account. If you are under 16, a parent or guardian must create and manage the account.
3.4 MatchTutor may suspend or terminate accounts that violate these Terms.
4.1 Tutors are required to submit verification documents during onboarding, including proof of qualifications and identity.
4.2 MatchTutor reviews submitted documents, however, we do not guarantee the authenticity of documents provided by Tutors. If a Tutor provides false, forged, or misleading documentation, all liability rests solely with that Tutor.
4.3 By submitting documents, Tutors warrant that all information provided is accurate, genuine, and not misleading.
4.4 MatchTutor reserves the right to remove any Tutor listing at any time at our discretion, including when there is reason to doubt the authenticity of submitted documents.
4.5 Students and parents acknowledge that while we take reasonable steps to verify Tutor credentials, we cannot guarantee the accuracy of information provided by Tutors and should exercise their own judgment when selecting a Tutor.
5.1 Reviews must be honest and based on genuine experience.
5.2 MatchTutor reserves the right to remove reviews that are fraudulent or abusive.
5.3 MatchTutor does not verify the content of any review.
6.1 You must not use the Platform to:
7.1 To the maximum extent permitted by Australian law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), MatchTutor is not liable for:
7.2 Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
8.1 You agree to indemnify MatchTutor from any claims, damages, or expenses arising from your use of the Platform or breach of these Terms.
Your privacy is important to us. Please see our Privacy Policy, which forms part of these Terms and is governed by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
10.1 All Platform content including the MatchTutor name, logo, and code is owned by MatchTutor and protected by Australian copyright law under the Copyright Act 1968 (Cth).
11.1 We may update these Terms at any time. We will provide reasonable notice to registered users before material changes take effect.
11.2 Continued use of the Platform after changes to these Terms constitutes acceptance of the updated Terms.
12.1 These Terms are governed by the laws of Australia. Any disputes will be subject to the non-exclusive jurisdiction of Australian courts.
